32 | The Director also acknowledged that unused children's furniture, classroom equipment, and other materials remained stored in one corner of the room. The Director stated that these items were kept in a designated storage area and maintained that they did not obstruct the room's exits, impede children's movement within the classroom, or otherwise create a safety hazard. The Director further stated that children were supervised while using the movement room and that the stored furniture and equipment were kept separate from the area used for gross motor activities.
As part of the investigation, LPA interviewed staff members S2 through S9 on May 13 and May 27, 2026, regarding the allegation. Staff generally provided information consistent with the Director's statements. Staff reported that the movement room is periodically monitored and maintained for children's use and that classroom furniture and equipment are arranged or repositioned as needed to maintain access within the room. Staff also stated that unused furniture and equipment stored in the room did not obstruct the room's exits or the areas used by children during activities. Additionally, several staff members reported that the movement room had been used infrequently, as children had primarily utilized the facility's outdoor play areas due to favorable weather conditions.
On May 13 and May 27, 2026, LPA inspected the movement room to assess the alleged safety hazards. LPA observed that unused children's furniture, classroom equipment, and other materials were stored in one corner of the room. The LPA observed that the materials were confined to a designated area. LPA observed two accessible exits from the room: one emergency exit leading directly to the outdoor play yard and one exit leading to the facility's interior hallway. At the time of the inspections, both exits were unobstructed and accessible. LPA did not observe the stored furniture or equipment obstructing either exit or blocking the primary pathways of travel within the room. Based on LPA's observations during the inspection, no conditions were observed that prevented safe egress or corroborated the allegation that the movement room contained blocked exits or other safety hazards.
Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur. Therefore, the allegation is determined to be unsubstantiated at this time. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the center director, Nicole Del Calvo. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit. |
