32 | facility sketch verified by LPAs McWilliams and Gutierrez on 5/12/2022 and Investigator Lomeli on 5/23/2022.
Licensee failed to be truthful to the Department regarding the areas of the home where care and supervision are provided to children. Furthermore, based off interviews conducted throughout the course of the investigation, Licensee disclosed that C2, an infant, sleeps in an adult bed with Licensee’s adult daughter while providing overnight care. Per safe sleep guidelines, all infants must sleep in a crib or play yard if unable to climb out of a crib or play yard.
A complaint investigation conducted by Investigator Lomeli revealed that Licensee has failed to provide adequate care and supervision that has resulted in the abuse of children. During a complaint investigation conducted by Investigator Lomeli, it was found that Licensee failed to report an unusual incident related to suspected child abuse and also failed to report Visalia Police Detective meeting with A1 regarding the suspected child abuse to the Department per the Department’s reporting requirement guidelines.
During a complaint investigation conducted by Investigator Lomeli on 05/23/2022 and 07/19/2022, Licensee failed to provide a current roster of the children. Furthermore, Licensee failed to provide Investigator Lomeli emergency paperwork for at least C3 and C2 was not listed on the roster.
Finally, During a complaint investigation conducted by Investigator Lomeli on 05/23/2022, Licensee disclosed that her hours of operation are Monday – Friday, 0700-1700 hours. On 07/19/2022, Licensee disclosed to Investigator Lomeli that her hours of operation are Monday – Friday, 0500-1700 hours and later stated that six children attend the daycare from 1800-0600 hours. Licensee provided Investigator Lomeli with a program statement, which indicates the facility operates 24 hours a day, seven days a week.
The licensee’s many dishonest statements to the Department are cause for concern, including that a person without a criminal record clearance is living at the facility. Given the licensee’s repeated misstatements, the Department cannot trust that the licensee will be truthful. Licensee is being issued a citation for Health and Safety Code (HSC) 1596.885 “Conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of this state.”
An exit interview was conducted with Licensee Rosalva Torres.
