On 4/07/2022, Licensing Program Analyst (LPA) Ocegueda conducted an unannounced case management inspection for the purposes of addressing an unusual incident that was self-reported to the Licensing Department by licensee on 3/10/2022. Upon arrival, LPA was greeted by staff #1 as licensee was conducting school drop offs. LPA then met with licensee Lydia Garcia, toured the facility and took a census.

On 3/10/2022, Licensee Lydia Garcia contacted the Department to indicate that on 3/9/2022, she had received notification from the parent of child #1 and child #2 about an incident that came to light involving inappropriate actions between two children in licensees care (Child #1 and Child #3). Child #2 stated to an adult outside the facility that he/she witnessed the incident. The incident was said to have occurred in one of the playrooms (exact area unknown) on or about the Summer of 2021 (exact date unknown) while licensee was cooking in the kitchen. It is unknown if any other staff were present or how many children were present.

When licensee Lydia Garcia was notified of the incident, she contacted the Licensing Department as well as local county Child Welfare Services (CWS) and the Visalia Police Department to file a report. LPA Ocegueda has submitted a records request to the Visalia Police Department but as of the time of this report, there had been no records provided by the Visalia Police Department.

Today, 4/7/2022, licensee stated that the Visalia Police Department informed her that due the age and nature of the incident, the Police Department would not be investigating further and instead referred the incident to Child Welfare Services. LPA will continue to investigate the incident further with the responding agencies.

Report continued to 809-C

Licensee stated that her practice had been to bring the younger children to the kitchen during cooking and regularly “make my rounds” or “check in” to where the older kids played in the other play spaces. Due to alleged incident, licensee now brings all the children to the dining area where she and assistants can visually observe them at all times. Licensee stated she takes this matter very seriously and does not want it to occur again.

Today, LPA interviewed staff and reviewed records. The children in care were not old enough to interview. Today, LPA reviewed supervision as required by Title 22 regulations. Licensee has a living room that is visually accessible and approved for care in front of the kitchen. LPA discussed with licensee that especially due to this alleged incident, it would be best practice to have the children use this visually accessible space while she is preparing meals if she has no other assistants to provide visual supervision in other approved areas of the home. LPA discussed personal rights by reminding licensee that all children have the right to be provided safe and healthful accommodations. Licensee stated she understood.

LPA explained that pending this Departments further investigative efforts and consultations with the other responding agencies (CWS and Visalia Police Department), future inspections could be conducted to further address this incident. Licensee stated she understood.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, no deficiencies are cited.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
