Violations
Text reproduced verbatim · Delaware Office of Child Care LicensingNearly every licensed provider accumulates some. A missing signature and an unlocked medicine cabinet are both “violations”, and they are not the same thing. Look at the class, the pattern over time and how quickly it was corrected — not the count alone.
Class is our grouping of the state’s own weights, reviewed per state. The agency’s own label is always shown beside it.
“Ensure staff files are complete. Four staff members need at least two hours in health and safety training. Two staff members need CPR/First Aid. Two staff members need a release of employment history form completed. Two staff members need documented attempts for service letters. Two staff members need two reference letters. One staff member needs a job description.”
“Ensure the exact departure time is recorded. One staff member was signed into the Pre-K classroom at 8:40 a.m. but was not present. Attendance records for the toddler classroom show that the same staff member was signed in at 9:05 a.m.”
“Ensure child files are complete. Two children needed a date of enrolment. One child needs hours and days of care.”
“Ensure cabinets are locked or that hazards are not accessible to children. The infant classroom has an unlocked lower cabinet, and several choking hazards are accessible. The hazards include plastic-containing craft items, plastic-wrapped paper towels, clothespins, and ribbon.”
“On August 7, 2025, the Office of Child Care Licensing (OCCL) received a complaint regarding procedures to address food allergies, administration of medication for not following the action plan of giving an EpiPen, and not notifying OCCL of a medication error for not giving the EpiPen. An investigation was conducted on August 13, 2025. The complaint is substantiated because the facility has food allergy procedures in place but failed to follow the plan by feeding the child a food they were allergic to, not obtaining an allergy action plan, not administering the EpiPen as indicated on the Medication Administration Record (MAR), and not contacting the parent or 911 immediately. The complaint is substantiated for not administering medication because the child exhibited signs of a mild reaction, becoming fussy, and a serious reaction of throwing up; the doctor s office administered the EpiPen, and the facility did not follow the MAR. The complaint is substantiated for not notifying OCCL of a medication error, specifically the failure to administer an EpiPen. Upon the child's arrival at the doctor s office, the doctor deemed it necessary to administer the EpiPen. An additional concern noted was a child had an allergic reaction, and the parent or guardian was not notified immediately after assisting the child and contacting an ambulance, as needed.”
“Enasre qualified staff are supervising the infant classroom. There was an intern in the infant classroom. This was corrected when an early childhood teacher was placed in the infant classroom.”
“Ensure staff files are completed. All staff members need to have professional development plans completed. One staff member needs an eligibility letter on file. One staff member needs Health and Safety for Child Care Professionals training, an adult abuse registry check, a health appraisal on OCCL s form, a release of employment history, and service letter attempts with follow-ups as necessary.”
“Ensure that child developmental plans are completed and updated at least three times a year. 11 children need developmental plans.”
“Ensure that children s hands are washed after meals. The one-year-old and two-year-old classrooms did not wash their hands after lunch.”
“Ensure the diaper pad is nonabsorbent. The one-year-old classroom diaper changing mat has holes in it.”
“Ensure any medication on site has a Medication Administration Record (MAR) and is labeled with the child s name. One child requires a MAR for antifungal cream and Aquaphor. Thirteen children require an MAR for diaper cream. Four children require an MAR for lotion. Three items do not have a child s name or MAR.”
“Infants require a monthly feeding schedule and must be updated monthly. One child s monthly feeding form requires a monthly update; the last update was on May 1, 2025. One child needs a monthly feeding form.”
“Ensure an annual renewal application is submitted 60 days before the license's expiration.”
“The Office of Child Care Licensing received a complaint on August 12, 2024, regarding improper discipline. An investigation was conducted on August 13, 2024. This complaint is substantiated because Administrator #1 stated she looked Child #2 in his eyes, pointed her finger at Child #2, and stated sternly, You need to get yourself together. Also, three children who were interviewed confirmed Administrator #1 and Staff #1 have yelled at children and two of those children stated Administrator #1 and Staff #1 have used their hands on children.”
“Ensure staff files are complete. Three staff need a health appraisal on OCCL's form, two staff need TB testing results, one staff needs service letter attempts, one staff needs documentation is on file showing enrollment in high school s early childhood education program.”
“Ensure walls are in good repair. The toddler and two-year-old classrooms need paint applied where it is peeling or chipped. The two sinks in the boy's bathroom need to be back in operation.”
“A renewal application is due 60 days prior to license expiration.”
“Ensure documentation of the designated teacher in the absence of the administrator is on file.”
“Ensure staff file are complete. Three staff need CPR and First Aid certification, one staff needs a profession development plan. annual review of safe sleep and abuse and neglect, an orientation, a job description, two references, employee declaration, drug and alcohol statement, adult abuse history check, health appraisal and TB results, a release of employment and service letter requests. Six staff need Heath and Safety for Child Care Professionals.”
“Ensure stained celling tiles are replaced.”
“Ensure the refrigerator in the one-year-old classroom has a thermometer that reads 40 degrees fahrenheit.”
“Ensure medication logs are completed for the infant classroom diaper cream use.”
“Ensure access to children is limited. LS McPhatter observed no staff in the facility main care area. There was access to the infant room, toddler room, and school age room from entry to the facility. Ensure the use of air fresheners is prohibited, LS McPhatter observed a plug in air freshener in the side entry way and in the toddler classroom. Ensure that unused electrical outlets and unused power strips or outlet multipliers are not accessible to children. LS McPhatter observed a outlet multiplier to the right of the side entrance with no covers and several outlets with no covers.”
“On June 23, 2022, OCCL received a complaint regarding the center not being kept in a clean and safe condition, lack of sanitation, possible lack of supervision, possible mold, insect infestation, and not following health exclusions. An investigation was conducted on June 28, 2022. The complaint is substantiated for not keeping the center clean because there was one light with a substantial number of water bugs and several ceiling tiles in the side entrance and the school-age classroom needed to be replaced. The complaint is substantiated for lack of supervision because upon arrival LS McPhatter noticed that there was no staff in the preschool area where 20 children were lying down on cots, most of them asleep. LS McPhatter entered the school-age classroom and saw Staff #2 insisting to Child #1 to remove herself from the school-age room to another area that is not authorized for care. There is no evidence to substantiate the complaint of lack of sanitation because LS McPhatter observed each open classroom and the kitchen, each had a bottle prepared for soap and water and another for disinfection. There is no evidence to substantiate the complaint of insect infestation, poor air quality, or mold because there was no insect evidence of infestation, no evidence of poor air quality, or evidence visible of mold growth. There is no evidence to substantiate the complaint of not following proper health exclusions because [name withheld] explained the health exclusion policies and procedures used by the center.”
“Ensure direct supervision is occuring at all times. LS McPhatter observed staff #1 leave the classroom with all 11 children to let 9 children out of the building to the bus. Staff #1 turned around and told the two remaining children to go back into the classroom while she stayed at the door to watch the others get on the bus. This was corrected when LS McPhatter informed Staff #1 that the children have to be with her if she intends to exit the school-age classroom threshold. Ls McPhatter explained direct supervision and how to remain in compliance.”
