Violations
Text reproduced verbatim · Texas Health and Human Services Commission, Child Care RegulationNearly every licensed provider accumulates some. A missing signature and an unlocked medicine cabinet are both “violations”, and they are not the same thing. Look at the class, the pattern over time and how quickly it was corrected — not the count alone.
Class is our grouping of the state’s own weights, reviewed per state. The agency’s own label is always shown beside it.
“There are no time records available for some of the caregivers and director.”
“The fire extinguishers have not been getting checked monthly.”
“Fire drills documentation is not available for review.”
“The carbon monoxide monthly checks have not been getting documented.”
“Emergency treatment authorization was not on file for children being transported to field trips.”
“Smoke detector monthly tests have not been getting conducted or documented.”
“The climbing equipment on the playground did not have the appropriate surfacing.”
“At the time of inspection 1/4 drivers did not have current transportation training available upon request.”
“A caregiver was supervising two groups at one time.”
“A caregiver was seen grabbing a child by the arm and pulling the child's arm.”
“A child was humiliated when she could not adequately participate in an activity, limited by her learning disability. In another instance, a caregiver yelled at a child.”
“The activity in the classroom did not accommodate a child's learning disability.”
“A volunteer without caregiver qualifications was left alone with children.”
“A child's file was missing the healthcare statement.”
“A caregiver's file only had 5 training hours available for review.”
“A child's file was missing release information.”
“A child's file was missing their current immunizations.”
“Three children's files were missing the detailed special care needs statement.”
“Three children's files were missing emergency contact addresses.”
“The caregiver's files that were reviewed did not have all of the trainings on file.”
“Three children's files were missing healthcare professional statements.”
“A caregiver's file was missing a notarized affidavit.”
“Five of eight children's records review did not have immunization documentation on file for review.”
“The operation does not have a current fire inspection. The director called the fire department to set up a fire inspection.”
“The director did not report child's allergic reaction requiring medical attention.”
“The child was fed cheese, an identified food that causes allergic reaction.”
“Allergy list is not posted in the child's room.”
“It was determined during a DFPS investigation that the caregivers did not notify the parent of the child's injury until 30 minutes after they noticed the child was favoring her arm and a total of 50 minutes after the initial injury.”
“During the DFPS investigation, an infant room caregiver stated that she was not allowed to carry any children due to her high-risk pregnancy. The caregiver was left alone in the room to care for the infants while the other caregiver was called to the front door to attend to parents picking up their children. The caregiver was unable to properly care for the injured infant and infants in care due to her health restriction.”
“One of eight children records reviewed did not have names and telephone numbers of persons that the child can be released to on file.”
“Six of eight children records reviewed did not have addresses for emergency contact information on file.”
“The operation failed to notify parent at pick up regarding their child's minor injuries.”
