Violations
Text reproduced verbatim · Texas Health and Human Services Commission, Child Care RegulationNearly every licensed provider accumulates some. A missing signature and an unlocked medicine cabinet are both “violations”, and they are not the same thing. Look at the class, the pattern over time and how quickly it was corrected — not the count alone.
Class is our grouping of the state’s own weights, reviewed per state. The agency’s own label is always shown beside it.
“This standard was evaluated during a DFPS investigation and was found to be deficient. Children were climbing on a pole with a material game piece. The caregivers did not intervene which resulted in one child climbing then falling. This resulted in the child receiving a head injury needing medical attention.”
“The operation's last carbon monoxide detector test was conducted on 01/13/26.”
“During the follow up inspection an 8 month old was present in the classroom with a child that was 2 years, 7 months old , and 3 years, 11 months old. This was corrected during the inspection when additional caregivers arrived and the infant was separated from the group and put into another room.”
“The operation's facility has an electronic smoke detection system. No documentation of the inspection from a monitoring company or the state or local fire marshal was available for review.”
“The operation's last fire drill was conducted on 01/13/26.”
“The operation's last carbon monoxide detector test was conducted on 01/13/26.”
“During the inspection a two year old toddler was observed leaving a classroom and entering another room unsupervised without the caregiver's knowledge. The caregiver realized that the toddler had left after the child returned to the room. The same child left the classroom once more a few minutes later, and was returned to the classroom by the director. During the inspection a four year old child was allowed by a caregiver to leave the gym and go to the dining area unsupervised to retrieve a water bottle.”
“During the inspection a cleaning product was kept in an unlocked cabinet and within reach of children, in the girls' restroom. This was corrected during the inspection when the director removed the cleaning product from the restroom.”
“During the investigation inspection it was determined that an employee was present with an inactivated background check on file. There was no Active background check present for the employee.”
“During review of the video for the investigation, it was observed that 3 infants were grouped with children who were aged 18 months or older than the infants; there was a total of 15 children in the group.”
“This standard was evaluated as part of the investigation and was found to be deficient. The director did not ensure that the operation was following minimum standards when the director did not ensure a caregiver was properly trained in the operation's policies and procedures before placing a caregiver in a room to work with children. In addition, the director did not ensure reports were made to parents and to Child Care Regulation within the required time frames.”
“The operation did not report an incident that placed children at risk to Child Care Regulation within the required time frames. The incident occurred on 2/23/2024 and was not reported to Child Care Regulation until 2/26/2024.”
“The operation did not provide the parent with an incident report after their child was placed at risk while in care.”
“This standard was evaluated as part of the investigation and was found to be deficient. Through review of video, it was determined a caregiver picked up a child by placing their right hand under the child's left armpit and their left hand around the child's right bicep/tricep. The caregiver carried the child approximately six feet then set the child down on a seat. When the child tried to get up from the seat, the caregiver grabbed and pulled on the child?s upper left arm to force the child to sit back down.”
“This standard was tasked over for the investigation and was found to be deficient. Through interviews with operation staff, it was determined that when the children were not following directions, a caregiver yelled at the children.”
“The operation did not immediately notify the parents after their child was placed at risk while in care. The incident where a caregiver grabbed and pulled a child occurred on 2/23/2024; the parents were notified on 2/26/2024.”
“Based on information obtained during a DFPS investigation, it was determined the operation did not comply with the parental rights legislative law regarding allowing a parent to review video of an alleged incident of abuse and neglect. Video was available to be released to law enforcement and investigators.”
“This standard was evaluated as part of a DFPS investigation and was found to be deficient. When law enforcement informed the operation of abuse and neglect allegations, the operation did not make a self-report within 48 hours.”
“During the course of the DFPS investigation, it was determined that there was not a caregiver present on the second level of the soft contained play equipment when children were playing on the second level of the play equipment.”
“Based on information obtained during a DFPS investigation, it was determined that a child received minor injuries when a caregiver was not supervising the children at a level that ensured their continued safety.”
“Based on information obtained during a DFPS investigation, it was determined that under the director?s leadership, a caregiver and the operation were not complying with the minimum standards.”
“Based on information obtained during a DFPS investigation, it was determined that one of the six children the caregiver was responsible for exited the building. The caregiver was unaware that the child was missing, and they no longer had their assigned six children in their care.”
“Based on information obtained during a DFPS investigation, it was determined that the parents were not immediately notified that their child left the operation for ten minutes and was brought back to the operation by a stranger.”
“Based on information obtained during a DFPS investigation, it was determined that children in care were not supervised at a level that ensured their continued safety.”
“The director had documentation showing 9 of the 30 hours of annual training were completed”
“The director was missing certificates showing 6 hours of annual training in management techniques, leadership, or staff supervision.”
“During interviews during the investigation inspection, it was determined a caregiver with a provisional status for their background check was left alone with a group of children in care on 7/12/2022. During the investigation inspection on 7/19/2022, the same caregiver was observed alone with a group of children in care. This was corrected at inspection on 7/19/2022 when another caregiver joined that caregiver with the group of children.”
“This standard was evaluated as part of an investigation and was found to be deficient. The operation did not notify all parents of children in the child-care center in writing as required after becoming aware that an individual associated with the operation had contracted a communicable disease.”
