Violations
Text reproduced verbatim · Texas Health and Human Services Commission, Child Care RegulationNearly every licensed provider accumulates some. A missing signature and an unlocked medicine cabinet are both “violations”, and they are not the same thing. Look at the class, the pattern over time and how quickly it was corrected — not the count alone.
Class is our grouping of the state’s own weights, reviewed per state. The agency’s own label is always shown beside it.
“In the outdoor area there are four slides, three slides were without loose-fill. One slide had loose-fill that is not the required 6 inches of depth due to mesh being exposed which can cause a trip hazard for children. Three of the four slides were removed from the outdoor play area.”
“In multiple classroom/bathrooms, the potty chairs were not emptied after use due to urine sitting in the bottom of the potty chairs. This was corrected at inspection once the potty chairs were emptied.”
“In the pre-k classroom, there was medication exposed next to the medication bottle on the teacher's table which was accessible to children. The teacher removed the medication and was placed out of reach of children.”
“There were multiple hazards observed that presented risk to children: *The under lining around the playground border was exposed posing a tripping hazard. * There were sharp metal wires accessible on the fence posing an injury hazard if children were too close to the fence. *There were wood logs deteriorating on the playground that could cause insect infestation to the playground area. *There was a gap in the wire fence wide enough to fit the child's head and extremities. *There was a gap at the bottom of the wood fence wide enough to fit the feet of children, to become a tripping or entanglement hazard and expose the grounds to environmental hazards.”
“The napping arrangement in one classroom made it difficult to walk in the room without having to step over children.”
“There was one slide that did not meet the 6 feet use zone requirements. The slide was too close and overlapped with the border that surrounds the slide.”
“There was one background check that has been pending since 10/16/2023. There was a total of 8 subjects on the background check list that were no longer associated with the operation. The background check people list was last validated on 10/29/2023.”
“Of the 6 children records reviewed, 3 files were missing the date of admissions for the children. * 4 children files were missing the address and phone number for the person listed as the emergency contact per 746.605(6). * 3 of the 6 children files were missing the Authorized Emergency care facilities address and phone number per 746.605(11) * 2 of the 6 children files were missing the Special Needs statements acknowledgement by the parents per 746.605 (13)(A). * 1 of the 6 children files was missing the Authorized Release person's name and phone number per 746.605(7).”
“There was one child observed napping in the kitchen area outside of the classroom, due to discipline. * This was corrected at inspection when the child was moved back into the classroom population.”
“A class was out of ratio by one child. This was corrected at inspection when a child was taken out of that class, and moved to another class.”
“One classroom did not have the emergency evacuation plan posted. *This was corrected at inspection when the plan was posted.”
“Out of 10 child files reviewed one was missing immunization records. *This was corrected at inspection when the parent brought the immunization records.”
“The operation was not current on the annual fire inspection. The last fire inspection was conducted on 3/15/2021. *This was corrected at inspection when the fire inspection was ordered.”
