Violations
Text reproduced verbatim · Texas Health and Human Services Commission, Child Care RegulationNearly every licensed provider accumulates some. A missing signature and an unlocked medicine cabinet are both “violations”, and they are not the same thing. Look at the class, the pattern over time and how quickly it was corrected — not the count alone.
Class is our grouping of the state’s own weights, reviewed per state. The agency’s own label is always shown beside it.
“It was determined during an investigation that the operation did not have manufacturing instructions for the kinder aged playground located at the operation. The operation did not provide documentation that they have taken action to correct the deficiency.”
“It was determined during the investigation that the caregiver used her cell phone to complete an incident report while still on the playground with the children present. The caregiver was alone with eight children and completion of the incident report took her attention away from the children she was responsible for.”
“It was determined during the investigation that the caregiver did not intervene to provide the victim with first aid treatment. The victim's eye was injured. Ice or other medical aid was not provided to the victim. The caregiver took the child back to the classroom after the injury on the playground and did not notify her immediate supervisor or another caregiver that the victim needed first aid for their injured eye, nor did the caregiver attempt to provided first aid themselves for the victim. The victim remained in the classroom injured until the parent picked up without first aid being provided.”
“It was determined during the investigation that the operation did not have manufacturing instructions for the kinder aged playground located at the operation.”
“It was determined during the investigation that the victim was playing on equipment that is not age appropriate for a twenty-three-month-old. The playground equipment was designed for older children and presented an injury risk to the victim.”
“Based on interviews with a parent and management, management did not contact Child Care Regulations to report a situation that placed a child at risk.”
“Based on interviews with staff and a parent, the operation was found not to be in compliance with the standard evaluated.”
“During the inspection, the door of the gate to exit the Pre-K playground would not open. This could pose a hazard for children to successfully evaluate away from the building.”
“A trash can with half eaten food is accessible to children. This can pose a risk of children ingesting an ingredient that may cause an allergic reaction and can cause the spread of germs. The director corrected the deficiency by placing a trash can lid on the trash can to prevent child access and moved the trash can against the classroom wall.”
“The standard is evaluated for a standard investigation is not found compliant. Based on the interviews with caregivers, management, and the victim's parent, a caregiver did not supervise a child appropriately which resulted in a child finger caught in a door.”
“A child does not have a health statement on file.”
“Annual training is available for 5 caregivers. Transportation training is not available for 2 drivers. Annual training is not available for the director.”
“A child with a diagnosis food allergy did not have a parent signature listed on the child's food allergy emergency plan.”
