Violations
Text reproduced verbatim · Texas Health and Human Services Commission, Child Care RegulationNearly every licensed provider accumulates some. A missing signature and an unlocked medicine cabinet are both “violations”, and they are not the same thing. Look at the class, the pattern over time and how quickly it was corrected — not the count alone.
Class is our grouping of the state’s own weights, reviewed per state. The agency’s own label is always shown beside it.
“Two of four children's records audited did not have current health statements on file.”
“The smoke detector was not working.”
“The carbon monoxide (CO) detector was not tested in August. This was corrected at inspection when the CO detector was tested.”
“The personnel record for the assistant caregiver was not available for review.”
“The operation did not have a list of employees posted on the parent board.”
“A fire drill was not conducted in the month of August.”
“Primary caregiver did not have the required 30 hour annual trainings for review at the time of inspection.”
“The infant on the swing did not have their safety straps fastened. This was corrected at inspection when the infant's safety straps were fastened.”
“An assistant caregiver did not have five of the required 24 annual training hours from instructor-led training.”
“A caregiver who was caring for the children did not have an active and eligible background check. The background check states it's pending.”
“Proof of liability of insurance was not provided annually by the anniversary date of the issuance of the permit.”
“One out of the four staff files reviewed during inspection did not have trainings available for review.”
“Three out of the four staff files reviewed did not include orientation.”
“The emergency relocation and evacuation diagram was not available for review during inspection.”
“Hazards such as roach spray were observed in an unlocked cabinet sink located in the children's restroom. Note: This was corrected at inspection as the spray was removed.”
“Children hands were not observed washed before eating snack. Note: This was corrected at inspection when children washed their hands before lunch was served.”
“The annual Child Product Safety Commission form for recalled products was not available for review. This was corrected at inspection when the primary caregiver completed, signed, and posted the form.”
“The complete personnel records were unavailable for review at inspection.”
“The liability insurance policy was unavailable for review.”
“There was one caregiver providing care at the operation that did not have a background check.”
“There were fourteen children in care with one caregiver. There were two children between the age of zero to seventeen months; eight children ages eighteen months to three years; and four children ages four years and older. The maximum number of children allowed for this age group was ten children to one caregiver. Therefore the child to caregiver ratio was deficient. This was corrected when one more caregiver was added and two children were picked up and removed from the operation. This left twelve children and two caregivers which is compliant for ratio.”
“There were fourteen children in care with a maximum capacity of twelve. This was corrected when a parent was called and two children were picked up.”
“Zero children were observed to wash hands prior to eating a morning snack.”
