How to read violations

Nearly every licensed provider accumulates some. A missing signature and an unlocked medicine cabinet are both “violations”, and they are not the same thing. Look at the class, the pattern over time and how quickly it was corrected — not the count alone.

5180:2-12-19 — Supervision

“During the inspection, it was determined that children were not being properly supervised. The following was observed: During the inspection, all infants were placed together on the rug, and mobile infants were observed crawling over non-mobile infants, causing the non-mobile infants to cry. One staff member was seated on the floor near the infants while feeding another child. The second staff member was occupied with other tasks in the room, including picking up toys and moving infants to and from cribs. Incident reports were reviewed. Nine incident reports were completed either within a day of each other or several on the same day at different times, documenting the same child biting other children. During staff interviews, employees stated that these incidents typically occur when one staff member is changing a diaper and the other is feeding a child. Staff reported that they now recognize the need to separate mobile infants from non-mobile infants to reduce the frequency of these incidents. Provide staff training. Submit the program’s corrective action plan, which includes a statement that training was provided, to the Department to verify compliance with the requirements of this rule.”

“During the inspection, it was determined that a child-care staff member had neglected a child when staff responsible for a group of children transitioning to outdoor play, left one child unattended in the classroom for approximately 15 minutes. Child care staff members, administrators, and owners must always use appropriate guidance and management methods with children and ensure that children are safe at all times. The individual needs to be released from employment immediately. Rule 5180:2-12-03 requires the program to notify parents when a serious risk non-compliance is cited. The notification must inform parents of the serious risk non-compliance and include the Department of Children and Youth website and location of further information regarding the determination. Submit the program’s corrective action plan, which includes a statement that the individual is no longer employed and a copy of the written parent notification, to the Department to verify compliance with the requirements of this rule.”
